Abstract

Panai Money (Shopping Money) which in Bugis language is called du’I panre is an amount of money given by the man to the woman during the applivation process (Mapettuada). In Islamic law, Panai Money does not have a legal basis, but Panai Money is stated in Sura Al-Baqarah verse 185 which in the verse explains about “God always makes it easy for every servant”. Giving Panai Money in the Bugis muslim community has become a hereditary tradition until now. The research was conducted to find facts in the community in Parigi District, Parigi Moutong Regency, Central Sulawesi Province on the use of Panai Money in marriages of the Bugis Muslim Community, with research that answer two problem formulations, namely (1) How is Panai Money in Islamic Law Perspective?, and (2) How to Panai the Perspective of the Bugis Muslim Community in Central Sulawesi?. This study ueses empirical law with a qualitative descriptive qualitative approach which in this approach uses real facts and evidence to be used in research and to find out the reasons why the Bugis Muslim Community continues to use Panai Money in terms of marriage. The research data was generated through observation, interviews and analyzed through 4 stages, namely: Data Reduction, Data Presentation, Data Verification, and Data Analysis.The results of this study indicate it is not explained whether or not the use of Panai Money is allowed in marriage, but it is called al a’dah as shahih or called urf shahih, which is a good custom, as explained in the fiqliyah rules al a’dah al muhakkamah, which means that a custom can be made law if it does not conflict with Islamic teachings because Panai Money has become a good habit and does not burden the prospective groom. And from six pairs of Bugis muslim communities in Central Sulawesi using Panai in marriage, the amount of which has been agreed upon by the prospective groom and the prospective bride’s family, the presence of this gift indicates that the prospective groom agrees to the marriage with the Panai Money. The use of Panai Mney in their marriage is for the purpose of the wedding, but there are also those who use Panai Money as capital after marriage.
