AKAD JUAL BELI BENIH UDANG (BENUR) DENGAN SISTEM TAKARAN PERSPEKTIF HUKUM ISLAM (STUDI KASUS DI DESA BLAWI KECAMATAN KARANGBINANGUN KABUPATEN LAMONGAN)

Abstract

The contract to buy and sell shrimp seeds with a measuring system in Blawi Village, Karangbinangun District, Lamongan Regency contains elements of gharar (deception), because the number of shrimp seeds purchased is not the same as the amount given to the buyer. The purpose of this study is to know about the practice of buying and  selling shrimp  seeds  with a measuring system  in  Blawi Village, Karangbinangun District,  Lamongan Regency, and to know and to analyze the Islamic Legal Perspective on the contract of buying and selling shrimp seeds with a measuring system in Blawi Village, Karangbinangun District, Lamongan Regency.This type of research uses empirical legal research. The research approach uses a sociology of law approach. Research data uses primary and secondary data. the contract process is carried out directly, come to the place during the harvest time or order the shrimp seeds first. When at the place of buying and selling transactions, there are sellers and buyers, then the buyer helps the seller in carrying out the measuring process, and it is finished measuring and the sampling process then the seller will tell the buyer what the average amount obtained, if the buyer agrees and agrees with the results of the quantity then the buyer will state that he would like to buy how many rean to the seller after that the seller will give shrimp seeds to the buyer according to his request,  then payment will be made. For the contract to buy and to sell shrimp seeds with a valid measuring system, it is carried out because here the seller and buyer are both willing and knowing each other about the losses and the profit to be made, and the buyer knows the process of the measurement directly and the process of sampling, besides that because the contract for buying and selling shrimp seeds is in accordance with the terms and conditions of the contract.
