Abstrak

Annulment of marriage is a process of annulment carried out because in marriage there is damage (fasakh). Problems that occur usually arise on the basis of non-fulfillment of desires. Many force or strive for something that happens to be fulfilled in their lives, such as falsification of data as one of the factors for the annulment of marriage. As for after the start of the annulment of the marriage, there will be legal consequences arising from the annulment of the marriage by the court. The research conducted used the perspective of Law Number 1 of 1974 concerning marriage. To analyze the legal consequences of the annulment of marriage due to falsification of data. with research that answers two formulations of the problem, namely (1) How is the annulment of marriage due to falsification of data perspective of Law Number 1 of 1974 concerning marriage ? and (2) What are the legal consequences of annulment of marriage due to falsification of data perspective of Law Number 1 of 1974 concerning marriage ? The purpose of this study is to find out and analyze the annulment of marriage due to falsification of data from the perspective of Law Number 1 of 1974 concerning marriage and to know the legal consequences of the annulment of marriage from the perspective of Law Number 1 of 1974 concerning marriage That this research has the nature of Library Research. This research method is a type of descriptive research that focuses on a process of explaining in a systematic way about a fact that has been obtained when the research is carried out, it can be seen from its nature, it is explained that this research uses descriptive analysis research. The result of this study is to analyze the problem of marriage annulment due to falsification of data with the main reference source of Law Number 1 of 1974 concerning marriage as an analysis knife. with the results of the study that the annulment of the marriage The result of falsification of the data described in Article 22 the marriage can be annulled , passing through the court proceedings described in Article 25 . Explained in the Reasons that can be put forward in the annulment of marriage, regulated in Article 27 with the main point of paragraph (3) with "misconceptions" against one of the spouses as the basis for annulment of marriage related to forgery due to dishonesty in personal identity data. in chapter 26, there are explained some preliminary problems that can corroborate the breakdown of the marriage. hence the annulment of marriage has legal Consequences described in Article 28 against children, against marital status ,and against common property.
