FIKIH SOSIAL: KONSTRUKSI KESADARAN HUKUM DAN TINDAKAN KOLEKTIF MASYARAKAT MUSLIM

Abstrak

Fiqh, as a product of Islamic law, is often understood normatively and individually, making it less responsive to social issues developing in Muslim society. This condition demands a fiqh approach that is oriented not only to legal validity but also to the formation of legal awareness and collective action within the community. This article aims to analyze the concept of social fiqh as an instrument for constructing legal awareness and driving collective action in Muslim society. This research uses a normative legal research method using a conceptual approach. The legal materials consisted of primary and secondary legal materials. Data were collected through library research, involving a systematic review of legislation, legal doctrines, scholarly books, journal articles, and other relevant legal sources. The results of the study indicate that social fiqh plays a crucial role in internalizing the values ​​of justice, welfare, and social responsibility, thus forming a legal awareness that is not individualistic but rather collective. Furthermore, social fiqh encourages collective action in Muslim society in the economic, social, and religious institutional spheres. Thus, social fiqh can be understood as a living fiqh that functions as a social ethic in the life of Muslim society.
