Urgensi Pemahaman Terhadap Hukum Islam Dalam Perkara Gugat Cerai Guna Melindungi Hak Suami Istri

Abstract

Marriage is a word to justify sexual relations between men and women, in order to realize family happiness which is filled with a sense of peace and affection by being blessed by Allah SWT. Divorce is a part of marriage, because there is no divorce without marriage first. Marriage is the beginning of living together between the life of a man and woman regulated in the Religious Law and the Holy Qur'an and the Regulations of Laws in a country, while divorce is the end of life with the husband and wife. Factors that cause divorce in terms of Islamic law, including the husband is not responsible, does not meet the economy, there is no harmony, interference from other parties, the husband is experiencing a moral crisis, persecution, forced marriage, underage marriage, criminal punishment, moral punishment, unhealthy polygamy, biological defects, political disputes. The negative impact for husband and wife who do not understand Islamic law in divorce cases, namely, the husband does not understand the rights and obligations of husband and wife, the difficulty of self-adjustment, the need to give mut'ah, pay off debt that has not been paid during the marriage.
