PERANAN PEJABAT PEMBUAT AKTA IKRAR WAKAF (PPAIW) DALAM PENDAFTARAN TANAH GUNA MENCEGAH TERJADINYA SENGKETA

Abstract

The role of PPAIW in terms of resolving waqf disputes is a rare event occurring around the people of Kediri City Subdistrict. For this reason, it is necessary to have new regulations governing such problems, so that the tasks and roles are clearer, because it is not possible if a PPAIW has a double burden on duty. This study aims to describe how the Role of the Official Endowment Pledge Act (PPAIW). The method used in this thesis is field research, namely research activities carried out in a particular community environment both in institutions, community organizations, and government agencies. Sources of data used in this study are primary data sources, data sources obtained from the Law or Regulation of the Minister of Religion and secondary data sources, data sources obtained from available documents or reports .The data collection method used in this study is the method observation, interview and documentation The analytical method used by the writer is descriptive, so that the analysis used by the writer will provide ideas and solutions to solve this problem, so that it can lead to a better and more advanced religious life.The results of the study explain that Peranan Official Wakaf Pledge Deed Actors in the KUA of the city of Kediri, namely only mediating or mediating between the parties in dispute to the achievement of consensus, and knowing that, the factors that make the dispute in the KUA city of Kediri include, among others, the conflict of the descendants of the expert waqif, internal conflict from individual nadzir, and the community's lack of knowledge of the waqf itself.
