STUDY KOMPARATIF PENDAPAT ULAMA SYAFI’IYAH DAN HANAFIYAH TENTANG HUKUM WAKAF TUNAI

Abstract

This research uses a literature study research approach, using descriptive comparative analysis design. Sources of data in this study are based on primary data and secondary data collected by library data collection methods. Furthermore, the data is analyzed through three stages namely: data reduction, data storage, and data verification.Based on data analysis, it can be concluded that the comparison of the opinions of Ulema Shafi'iyah and Hanafiyah regarding cash waqf laws both assume that money cannot be represented because when money is used as a means of payment then the value of money will run out. According to Hanafiyah Ulema money can be used as waqf property even though money will easily run out, but the benefits of waqf money can be beneficial continuously making business capital through mudaraba.
