LEGALISASI HUKUM ISLAM DI INDONESIA
Abstract
The urgency of this article is to put forward the idea of the importance of Islamic legal legislation, for example, to decide a case in court, it is not enough to just rely on the fatwa of ulama, the opinions of Iqh experts or classical books containing the legal opinions of madzhab imams from around 13 centuries ago. Therefore, Islamic legal legislation is an effort to positivize legal values. Thus, the presence of laws governing marriage, endowments, managing zakat, organizing the Hajj pilgrimage and the presence of sharia economics in the realm of a rational legal system no longer needs to be debated, even though along the way there are pros and cons that need to be found for alternative solutions. Because it allows the birth of disparity of decisions in the same case and obscures legal certainty.
