Nushuz dan Dampaknya Terhadap Perceraian di Pengadilan Agama Kota Kediri

Abstract

Based on the title of the research that raised the theme of Nushuz, as an expression and attitude of concern for many divorce cases that occurred in the community, the author was called to find out more about the legal considerations of the judges in the resolution of divorce cases caused by Nushuz. Researchers use a qualitative research approach that aims to facilitate researchers because researchers who are directly involved in addition to social data are difficult to ascertain the truth then by collecting data in triangulation (combined). To understand complex social interactions can only be described if researchers conduct research using qualitative methods with in-depth interview data collection techniques and participatory observation to participate in feeling what the person feels. Factors that can cause Nushuz's actions include: economic factors, career factors, jealousy, sexual factors, miserly husband, lack of responsibility, lack of religious education. Nushuz is not only attached to or comes from the wife but also from the husband with a solution if one of the parties, both husband or wife has been advised to make peace or ishlah. Nushuz and its consequences according to Islamic Marriage Law can lead to termination of marriage.
