Tinjauan Hukum Islam Terhadap Adat (Turun Telu) Dalam Pernikahan

Abstract

Human nature in the interests of couples who are channeled through the sacred ties of marriage must expect ease and pleasure from both families. Such hopes are not uncommonly hampered by the traditional beliefs of the family that can have various consequences. This phenomenon is still common on the island of Java. one of the phenomena that occurs is because trustee trust in adat down telu resulting in a refusal to become a marriage guardian. Islam has set the provisions of who is permitted and permissible to be a life partner that has been elaborated in the Al-Qur'an Al Karim. This research is a descriptive qualitative study using primary data from interviews with the presentation of detailed descriptions and using literacy materials so that it can support the credibility of the data presented by researchers. As for the results of the research in relation to the marriage of the couple Anna and Mukhlis, it was allegedly customary only as a medium of subtle rejection of the trustee because there were other factors that were more primary and reviewed from Islamic law relating to the decline of telu no clear information was found, so according to the Law Islam is a marriage the couple is allowed in religion, because it is not contrary to the propositions of the texts and opinions of the scholars.
