Iddah Bagi Wanita Menyusui Dalam Perspektif PP RI Nomor 9 Tahun 1975 Dan Kompilasi Hukum Islam

Abstract

This research focuses on the study of waiting time issue (iddah) for women who are breastfeeding from various sources of marriage law in force in Indonesia, namely in terms of Government Regulation No. 9/1975 concerning the implementation of Law No. 1/1974, in terms of Compilation of Islamic Law, along with how to calculate the iddah period applied in Pare District Religion Office. This study aims to determine the iddah time of women who are breastfeeding in the perspective of Government Regulation of the Republic of Indonesia Number 9 of 1975 concerning the implementation of Law Number 1 of 1974, in the perspective of Islamic Law Compilation, and to find out how to calculate the iddah period of women who are breastfeeding in implementation marriage contract at the Office of Religious Affairs, Pare District, Kediri Regency. The period of iddah for women who are breastfeeding according to the Compilation of Islamic Law is divided into 2 types. For breastfeeding women who do not experience menstruation, the iddah period is 3 times counted since the first menstruation. As for breastfeeding women who have gone through menstruation 3 times, the iddah depends on the cause, whether divorced or divorced. If the divorce is alive, the iddah becomes 3 times counted since the official divorce certificate was issued from the Religious Court, and if the divorce dies, the iddah period is 130 days from the day of her husband's death.
