IMPLEMENTASI UNDANG-UNDANG NOMOR 16 TAHUN 2019 TERHADAP BATAS USIA MINIMAL DALAM PERKAWINAN DI KUA KECAMATAN SINDANG KELINGI, KABUPATEN REJANG LEBONG, PROVINSI BENGKULU

Abstract

Marriage is a translation of the words nakaha and zawaja. Nakaha means 'to gather' and the term zawaja means 'couple'. Thus, in terms of language, marriage means the gathering of two people who were originally separate and independent, into one unified whole and partnered in a husband and wife pair. In order to form a sakinah mawaddah warahmah family, of course, it is necessary to have maturity in thinking and acting between the two. Therefore, age maturity becomes very important to be prioritized as a measure of one's readiness to unite the vision of life with their partner. Based on these considerations, the Government then changed Law No. 1 of 1974 Article 1 Paragraph (7) concerning the Minimum Age Limit in Marriage by stipulating a new Law No. 16 of 2019 which in this case the minimum age for marriage for women is the same as the minimum age for marriage for men. , which is 19 (nineteen) years. As an effort to measure the implementation of Law No. 16 of 2019 concerning the Minimum Age for Marriage, field research was carried out in Sindang Kelingi District, Rejang Lebong Regency, Bengkulu Province using a qualitative approach. In this case, field research was carried out through observation for data collection and followed by interviews with KUA officers, community leaders and ordinary people. By using this research method, it is concluded that Law No. 16 of 2019 has not been effective, even though the results of the interview have stated that it has been effective. However, the statement still cannot be an appropriate measure without written evidence. And from the written evidence that the researchers got at the KUA of Sindang Kelingi District, it was concluded that it had not yet been implemented and run effectively as expected by the government.
